Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and AllayGames (“we”, “us”, “our”) regarding your use of the Astralia game (the “Game”) and this website (together, the “Services”). By installing, accessing or using the Services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old, or the higher minimum age that applies in your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use, including any purchases.

2. Your account

• An account is created automatically when you first launch the Game. You may link it to a Google or Apple account to keep your progress across devices.
• You are responsible for all activity on your account and for keeping access to it secure.
• Accounts are personal. You may not sell, buy, rent, share or transfer accounts, or use another player’s account.
• Your player name must not infringe anyone’s rights or be offensive, misleading or impersonate others. We may change names that break this rule.

3. Licence to use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Game for your own non-commercial entertainment on devices you own or control. All rights not expressly granted to you are reserved.

4. Virtual items and currencies

• The Game includes virtual items, currencies, levels and other content (“Virtual Items”). Whether earned or purchased, Virtual Items are licensed to you, not sold, and you do not own them.
• Virtual Items have no monetary value, cannot be exchanged for real money, goods or services, and may not be sold, traded or transferred outside the Game.
• We may adjust, rebalance or remove Virtual Items as part of running the Game. Where we remove purchased content in a way that materially affects you, we will act in accordance with applicable law.
• Some features give random rewards. The odds of receiving each reward are shown in the Game before you use them.

5. Purchases and subscriptions

• Purchases are processed by the Apple App Store or Google Play and are subject to their terms. Prices are shown in the store before you confirm a purchase.
• Refunds are handled by the store you purchased through, in line with its refund policy and applicable law.
• Purchased digital content is delivered immediately. Where the law allows, by completing a purchase you request immediate delivery and acknowledge that you lose your statutory right of withdrawal once delivery begins.
• Subscriptions renew automatically until cancelled. You can cancel them at any time in your App Store or Google Play account settings. Deleting your Game account does not cancel a subscription.
• Parents and guardians can restrict purchases using the parental controls of their device or store.

6. Promo and invitation codes

Promo and invitation codes have no cash value, may have limited validity and quantity, and may be used only once per account unless stated otherwise. We may cancel codes and any rewards obtained through fraud, automation or other abuse.

7. Rules of conduct

When using the Services, you must not:

• use cheats, bots, automation, modified clients or any unauthorised third-party software;
• exploit bugs or errors instead of reporting them to us;
• interfere with, overload or attempt to gain unauthorised access to our servers, systems or other players’ accounts;
• harass, threaten, insult or discriminate against other players, or post content that is illegal, hateful, sexually explicit or otherwise offensive;
• spam, advertise, or offer to buy or sell accounts, Virtual Items or services for real money;
• impersonate AllayGames staff or any other person;
• reverse engineer, decompile or copy the Game, except where the law expressly permits it.

8. Your content

You remain responsible for the content you create in the Game, such as names, chat messages and clan descriptions. You grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute that content within the Services for as long as it is available there. We may remove content that breaks these Terms.

9. Enforcement

If you break these Terms, we may take action proportionate to the violation, including warnings, chat restrictions, removal of Virtual Items obtained improperly, and temporary or permanent suspension of your account. Except where the law requires otherwise, you are not entitled to a refund for Virtual Items lost as a result of such action. If you believe we have made a mistake, contact support.

10. Changes to the Game and availability

The Game evolves: we may add, change or remove features, content and balance. The Services may be temporarily unavailable for maintenance or for reasons outside our control. We may discontinue the Game; if we do, we will give reasonable advance notice in the Game.

11. Intellectual property

The Services, including all software, artwork, characters, music, text and trademarks, are owned by AllayGames or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of these rights to you.

12. Third-party services

The Services rely on third-party services such as the App Store, Google Play, Google and Apple sign-in, and Discord. Your use of them is governed by their own terms, and we are not responsible for them.

13. Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted or error-free, or that your progress will never be lost. Nothing in these Terms affects the statutory rights you have as a consumer that cannot be excluded.

14. Limitation of liability

To the extent permitted by law, AllayGames is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability to you in connection with the Services is limited to the amount you paid to us in the 12 months before the claim arose. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by law.

15. Ending this agreement

You may stop using the Services at any time and delete your account — see Account deletion. We may suspend or terminate your access as described in section 9, or if we discontinue the Game. Sections that by their nature should survive termination will continue to apply.

16. Governing law and disputes

These Terms are governed by the laws of the country in which AllayGames is established, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in its courts. Before starting formal proceedings, please contact us — most issues can be solved quickly.

17. Changes to these Terms

We may update these Terms to reflect changes to the Services or the law. We will publish the new version on this page and, if the changes are significant, let you know in the Game before they take effect. If you continue to use the Services after that, you accept the updated Terms.

18. Apple App Store

If you downloaded the Game from the Apple App Store: these Terms are between you and AllayGames, not Apple; Apple has no obligation to provide maintenance or support for the Game; Apple is not responsible for any claims relating to the Game; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services.
